Terms of Service

These terms of service ("Terms") govern the provision of landscaping and pine fencing services by Green Fingers Property Care ("we", "us", "our") to you ("the Customer", "you", "your"). By engaging our services, you agree to these Terms.

1. Quotes and Estimates

We provide free, written quotes for all projects following an on-site assessment. Quotes are valid for 30 days and become binding when you provide written acceptance (including email or text message). If site conditions differ materially from what was observed, we will provide a revised quote before proceeding.

2. Scope of Work

The scope of work is defined in your accepted quote. Variations require a written quote for additional work before proceeding. We reserve the right to suggest alternative materials or methods if needed, with your agreement.

3. Project Scheduling and Access

Start dates may be subject to weather, material supply, and our current schedule. You agree to provide reasonable access to your property during agreed working hours. We take reasonable care to protect your property during construction.

4. Materials

We use quality materials suited to Gold Coast conditions. Treated pine timber meets Australian Standards for the specified treatment level. Natural materials may have natural variations in colour and texture. Plant health at planting is guaranteed, but ongoing survival depends on maintenance and environmental factors.

5. Payment

Payment terms are specified in your accepted quote. For larger projects, we may require a deposit, progress payments, and final payment upon completion. Invoices are due within 7 days unless otherwise agreed.

6. Cancellation

You may cancel before work commences by providing written notice. If materials have been ordered, you agree to reimburse those costs if they cannot be returned. If work has commenced, you will be invoiced for work completed to date.

7. Weather and Delays

Outdoor work is subject to weather conditions. Weather delays do not constitute a breach of these Terms. We are not liable for delays caused by factors outside our reasonable control.

8. Workmanship Warranty

We provide a 12-month workmanship warranty from project completion covering defects in our workmanship. This warranty does not cover normal wear and tear, damage by third parties or storms, failure to follow aftercare instructions, or natural movement and weathering of materials.

9. Liability

Our liability is limited to re-performing defective work or refunding the attributable portion. Nothing in these Terms excludes rights under the Australian Consumer Law.

10. Insurance

Green Fingers Property Care holds public liability insurance appropriate to our services. Details are available on request.

11. Intellectual Property

Designs and plans remain our intellectual property until full payment. We may photograph completed projects for our portfolio unless you opt out in writing.

12. Disputes

Both parties agree to first attempt resolution through direct negotiation. If unresolved within 14 days, either party may refer the matter to mediation through QCAT. These Terms are governed by Queensland law.

13. Privacy

We handle your personal information in accordance with our Privacy Policy.
